Supreme Court may consider case challenging same-sex marriage ruling




WASHINGTON (ABC36 NEWS NOW) – Ten years after the Supreme Court legalized same-sex marriage nationwide, the justices may soon decide whether to revisit that ruling.


Former Rowan County, Kentucky Clerk Kim Davis, who was jailed in 2015 for refusing to issue marriage licenses to a same-sex couple, is appealing a federal court decision that found her responsible for damages.


Her attorneys argue that her actions were protected under religious freedom and claim the original Supreme Court ruling was incorrect.


The case comes as some states pursue legislation aimed at blocking marriage licenses for LGBTQ couples and encourage the court to reconsider its landmark decision.


The Supreme Court is expected to decide this fall whether it will hear the case. If it moves forward, a ruling could come by mid-2026
